GoonRips Terms of Service

These Terms of Service ("Terms") govern your use of the GoonRips website at goonrips.app and any related services (the "Service"). The Service is operated by HYD Holdings Inc ("HYD", "we", "us", "our"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. What GoonRips is

GoonRips is a free, online card-collecting game. You open virtual card packs and build a collection. The Service contains no explicit content.

Cards may show the names and images of real people. Their appearance does not mean they sponsor, endorse, or are affiliated with GoonRips or HYD, unless we say so on the card. Anyone shown on a card can ask us to remove it (see section 8).

GoonRips contains promotions for other products, including Moment, an app operated by one of our affiliates.

2. Eligibility: 18+

You must be at least 18 years old, and old enough to form a binding contract where you live, to use the Service. The Service is intended for adults only and is not directed to anyone under 18. By using it you confirm you are 18 or older.

3. Your account

• You sign in with a one-time passcode sent to your email address. You are responsible for keeping access to that email address secure and for activity under your account.
• Your username must not impersonate anyone, and must not be offensive or infringe anyone's rights.
• You may delete your account at any time by contacting us at support@goonrips.app.
• We may suspend or close your account as described in section 13.

4. Virtual cards and packs

• Cards, packs, and collections are virtual items with no monetary value. They are not property, cannot be exchanged for money, and you do not own them. We grant you a limited license to use them within the Service.
• The Service is free. You may not sell, trade, or transfer cards or accounts for money or anything of value, inside or outside the Service.
• Pack contents are random. We may change card designs, pack contents, odds, or the game itself, and may reset or remove cards or collections, at any time.

5. Acceptable use

You agree not to:

• use the Service unlawfully, or on behalf of anyone under 18;
• use bots, scripts, or other automated means to open packs, create accounts, or access the Service;
• create multiple accounts to gain an advantage, or to get around a suspension or the age limit;
• attempt to gain unauthorized access to the Service or its systems, or interfere with them;
• copy, scrape, resell, or commercially exploit any part of the Service;
• reverse engineer or extract source code from the Service, except where the law forbids this restriction;
• harass, threaten, or harm others, or infringe their rights.

If you find a security vulnerability, report it to support@goonrips.app and do not access or keep data that is not yours.

6. Your content

You own the username and anything else you submit. You give us a limited, non-exclusive license to host, store, and display it to run the Service. If you send us feedback, we may use it without any obligation to you.

7. Emails from us and our affiliates

We email you a one-time passcode to sign in. We, and our affiliates (companies that control, are controlled by, or are under common control with HYD), may also send you marketing emails about GoonRips and our affiliates' products and services. Every marketing email will include an unsubscribe link, and unsubscribing does not affect your account. See our Privacy Policy.

8. Requests from people shown on cards, and copyright

If you are shown on a card, or you hold rights in a name, image, or other material used in the Service, and you want it changed or removed, email support@goonrips.app with:

1. your name and contact details;
2. the card(s) or material concerned;
3. the basis of your request (for example, that it is you, or that you own the rights); and
4. a statement that the information in your request is accurate.

We will review requests promptly and, where appropriate, remove or change the material. We may ask for information to verify a request.

9. Our intellectual property

The Service and its contents (software, design, text, graphics, and the GoonRips name and logos) are owned by HYD or its licensors. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your own personal, non-commercial use. All other rights are reserved.

10. Third-party services and links

The Service may link to or promote third-party websites, apps, and services, including Moment. We are not responsible for them, and their own terms and privacy policies apply.

11. Disclaimer of warranties

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any collection or progress will be kept.

12. Limitation of liability

To the fullest extent permitted by law, HYD and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, progress, profits, or goodwill, arising out of or related to the Service. Our total liability for any claim relating to the Service will not exceed USD $50. Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for gross negligence, fraud, or willful misconduct.

13. Indemnity

To the extent permitted by law, you agree to indemnify and hold harmless HYD and its affiliates from any third-party claims, damages, or expenses (including reasonable legal fees) arising out of your misuse of the Service or your violation of these Terms, any law, or the rights of a third party.

14. Changes and termination

We may change or discontinue any part of the Service, and may update these Terms. When we make material changes we will update the "Last updated" date and notify you on the site or by email. If you keep using the Service after changes take effect, you accept them.

You may stop using the Service at any time. We may suspend or close your account, or remove cards or progress, if you are under 18, break these Terms, or we reasonably believe your use involves fraud, abuse, or a security risk, or if the law requires it or we stop offering the Service. Where practical we will tell you first. Sections 6 (as to feedback) and 11–16 survive termination.

15. Governing law, disputes, and arbitration

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-laws rules, and by the Federal Arbitration Act for the arbitration agreement below. For any dispute not subject to arbitration or small claims, you agree to the exclusive jurisdiction of the state courts in Fairfax County, Virginia, and the federal courts for the Eastern District of Virginia, except where the law gives you the right to sue in your local courts.

Informal resolution first. Before starting arbitration or a small-claims case, each side will send the other a written notice describing the dispute (to us at support@goonrips.app, to you at your account email) and try in good faith to resolve it for 60 days. Limitation periods are paused during those 60 days.

Binding individual arbitration. If we cannot resolve a dispute informally, it will be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules and, where they apply, its Mass Arbitration Supplementary Rules. It will take place by video or in the county where you live. Fees follow the AAA rules, and we will pay any filing, administrative, and arbitrator fees above what those rules require you to pay. Either side may bring an individual claim in small-claims court, or seek relief in court to stop misuse of intellectual property.

Class action and jury trial waiver. Claims may be brought only individually, not as a plaintiff or class member in any class, collective, or representative proceeding, and both sides waive any right to a jury trial. If this waiver is unenforceable for a claim, that claim will be decided in court under the jurisdiction paragraph above.

Opting out. You may opt out of arbitration by emailing support@goonrips.app within 30 days after you first accept these Terms, with the subject "Arbitration Opt-Out" and your account email.

16. General

These Terms are the entire agreement between you and us about the Service. If any part is unenforceable, the rest remains in effect. Not enforcing a provision is not a waiver. You may not assign these Terms; we may assign them in a merger, acquisition, or sale of assets, or to a successor that continues the Service. We may send you notices by email or on the site.
